These terms govern your use of Puuunch. By creating an account or using the service, you agree to these terms.
Acceptance of terms
By accessing or using Puuunch, you agree to be bound by these terms. If you use the service on behalf of an organization, you represent that you are authorized to bind it.
The service
Puuunch is a time-tracking tool for logging hours, managing projects and expenses, generating reports, and submitting timesheets for approval. We may evolve the service’s features over time.
Accounts and responsibilities
You are responsible for the accuracy of your account information, the confidentiality of your credentials, and the activity that occurs in your account. Notify us promptly of any unauthorized use.
Acceptable use
You agree not to use Puuunch for unlawful purposes, not to attempt to compromise its security or integrity, not to access it through unauthorized automated means, and not to interfere with its operation for other users.
Free trial, subscription, and payment
Puuunch may offer a free trial. After that, continued access may require a paid subscription at the rates shown on our pricing page. Applicable fees, billing frequency, and renewal terms are presented to you before any payment.
Per-seat billing. The subscription is billed per seat, to the organization. The seat count is the one the account owner configures; you can add or remove seats at any time from the Billing screen.
Automatic renewal. The subscription renews automatically at the end of each period (monthly or annual) until cancelled. You may cancel at any time; cancellation takes effect at the end of the current period.
Refunds. Periods already paid for are not refunded, except where the law requires it. Reducing the seat count takes effect at the next billing period.
Price changes. We may change our rates on at least 30 days’ notice, sent by email or shown in the app. The new rate applies from the billing period following the end of that notice. If the new rate does not suit you, you may cancel before it takes effect.
Failed payment. If a payment fails, we notify you and you have 14 days to update your payment method. After that, access to time and expense entry may be restricted. Your data stays readable and exportable; we do not delete it for non-payment.
Taxes. Displayed rates exclude taxes. Applicable taxes (GST/QST) are added to the invoice.
Payments are processed by Stripe. We never see or store your card number.
Your data
You retain ownership of the data you enter into Puuunch. You grant us the rights needed to host and process that data in order to provide the service. Our handling of your personal information is described in our privacy policy.
Intellectual property
Puuunch, its logo, software, and content belong to us and are protected by applicable law. These terms grant you no rights in our trademarks or intellectual property, other than the right to use the service.
Availability and changes
We strive to provide a reliable service, but it is provided “as is” and may be subject to interruptions or maintenance. We may modify, suspend, or discontinue features.
Puuunch is run by one person. Support is by email during normal business hours (Eastern time), with no guaranteed response time and no uptime commitment (no SLA). We would rather say so plainly: that is the trade-off of a deliberately small, inexpensive tool.
Changes to these terms. We may update these terms on at least 30 days’ notice for any material change, sent by email or shown in the app. If a change does not suit you, you may stop using the service and cancel before it takes effect; continuing to use the service after that date means you accept it.
Limitation of liability
The service is provided “as is”, without warranty of any kind, express or implied, including any warranty of merchantability or fitness for a particular purpose.
To the extent permitted by law, Puuunch is not liable for indirect, incidental, punitive, or consequential damages, or for loss of data, revenue, or profits arising from your use of the service.
Liability cap. To the extent permitted by law, our total liability for any claim relating to the service is limited to the lesser of: the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim, or CAD $500.
Your own backups. We back up the database for disaster recovery, not as an archiving service on your behalf. You remain responsible for exporting and keeping your own records — export is available at any time, free of charge.
Nothing in these terms limits any rights you have under applicable consumer-protection law, or our liability for gross negligence or wilful misconduct.
Termination
You may stop using the service and close your account at any time; termination takes effect at the end of the current billing period. We may suspend or terminate access for breach of these terms or for abuse.
Export your data before closing. Every person can download all of their own information from Account → Your data. Managers can additionally export all of the organization’s records from Settings → Export, and reports to CSV.
After deletion. Deleting an organization is irreversible. We retain it for 30 days (so an accidental deletion can be undone), after which it is permanently deleted along with all of its content, including receipts.
If we ever discontinue the service, we will give you at least 60 days’ notice and keep data export available throughout that period.
Governing law
These terms form an agreement between you (or the organization you represent) and Dominic Martineau, an independent contractor based in Quebec, who operates Puuunch. They are governed by the laws of the Province of Quebec and the laws of Canada applicable therein, without regard to conflict-of-law rules.
Jurisdiction. Any dispute relating to the service or these terms falls under the exclusive jurisdiction of the courts of the judicial district of Quebec, and you consent to that jurisdiction.
Failure to enforce a right under these terms is not a waiver of that right. If any provision is held invalid, the remainder stays in force.
